Tanner & Associates-The Leader in Non-Lending Related Transactions While property appraisals are most often associated with lending transactions (i.e., new home purchases or refinancing of an existing loan) there are in fact many non-lending related scenarios, in which an appraisal is required. Attorneys and accountants rely on an appraiser’s professional opinion of value when calculating residential or commercial real property values for estates, divorces, bankruptcy, and other disputes/settlements requiring a determination of value for real property. At Tanner & Associates, our staff understands the specific needs of these professionals and are experienced in interacting with all parties involved. We provide appraisal reports that meet the stringent requirements of the courts and various governmental and private agencies.

DIVORCE OR MARRIAGE DISSOLUTION APPRAISAL

Appraisals conducted for divorce purposes must establish fair market value for the residential and/or commercial real estate involved. Divorce, whether settled in court or through mediation, is often a very emotional circumstance that requires professional service in various aspects. Appraisals must be accurate, objective and precise. The finalization of a divorce determines which party retains formerly common property, and/ or how assets are to be divided. There are generally two options regarding the house or other commonly held real estate-it can be sold and the proceeds divided, or one party can "buy out" the other. In either case, one or both parties should order an appraisal of the residence. Appraisals for purpose of marriage dissolution require a well-supported, professional opinion of value that is defensible in court. When you order an appraisal from us, you can be assured that you will get the highest quality appraisal, conducted with sensitivity and professionalism.

Often the date of dissolution differs from the order date of the appraisal. We are familiar with the procedures and requirements necessary to perform a retroactive appraisal with an effective date and fair market value estimate matching the date of divorce. The ethics provision within the Uniform Standards of Professional Appraisal Practice (USPAP) binds us with confidentiality, ensuring the fullest degree of discretion.

PROBATE APPRAISALS OR DATE OF DEATH VALUATIONS

There are many situations –often stressful and complex in nature – in which an appraisal of property is needed to state an opinion of property value on a specific date in time. Determination of estate tax liability and the disposition of assets under a will or in probate are just two common non-lending situations, in which an appraisal is necessary. It is not uncommon for the necessary “effective date” of these types of reports to be several months, or even years, prior to the date of order. Similarly, for estate tax purposes or disposition of the assets of a decedent, a "date of death" valuation is often required.

BANKRUPTCY APPRAISALS

When bankruptcy is filed, the debtor is required to produce an expense report which outlines the net worth of his/ her assets. An appraisal is necessary in order to obtain the opinion of value for any real property the debtor may own. It is important to choose an appraiser who can produce an accurate opinion of value, and is able and willing to testify to his/ her findings if needed, either via deposition or court appearance, within the strict guidelines and time-constraints observed in these legal proceedings.

Attorneys, accountants, executors and others rely on Golden State Appraisals, Inc. for these types of complex and specific valuations because such appraisals require special expertise and training. They require a firm that is established and can effectively research comparable contemporaneous sales, utilizing several different databases and resources. Regardless of your specific appraisal needs, you need a professional real estate appraiser, bound by the Uniform Standards of Professional Appraisal Practice (USPAP) for a high degree of confidentiality and professionalism, and you need the kind of quality report and work product taxing authorities and courts need and expect.
